O objetivo deste comentário é explicar o importante papel que a Convenção de Nova Iorque tem desempenhado no desenvolvimento da arbitragem na América Latina, enfatizando a influência que exerceu sobre a Convenção Interamericana em arbitragem comercial internacional de 1975, normalmente referida como "Convenção do Panamá". Igualmente pretende-se identificar as similaridades e diferenças entre as duas Convenções, e mencionar algumas desaprovações à Convenção do Panamá, alcançando uma conclusão que talvez seja inquietante para alguns.
